An All Progressives Congress, APC, gubernatorial aspirant in Jigawa State, Hon. Farooq Adamu Aliyu has asked the Federal High Court to stop the party from participating in the upcoming 2023 governorship election.
Aliyu, who participated in the party’s primary election in the state along with other aspirants, lost to the current Deputy Governor Malam Umar Namadi.
The former minority leader in the green chamber representing Birnin Kudu/ Buji Federal Constituency dragged the APC to court, asking it to stop the party from participating in the governorship election because the party has no candidate.
He also asked the court to compel the party to refund his N50 million nomination form fee and to pay him N500 million in damages.
The Federal High Court sitting in Dutse, Jigawa State capital, on Tuesday adjourned the judgement till further notice after hearing affidavits and counter-affidavits from the plaintiff and defendants.
Presiding Justice Hassan Dikko adjourned the case until another day which will be communicated to both applicants and respondents.
The court had earlier fixed Tuesday 16 and Wednesday 17 of this month for judgement.
Speaking to journalists after the court proceeding, the leading counsel to the plaintiff, Hon. Onyechi Ikpeazu SAN, said they are in court to challenge the process because it failed to comply with the constitution of the party.
Also speaking, the lead counsel to the defendants, Mr Yakubu Abdullahi Ruba SAN, said the court has attended all the parties and adjourned the sitting for judgement to a date to be communicated later.
